1. PURPOSE AND DEFINITIONS

1.1 Purpose of the Terms and Conditions

The APACA Location website is an intermediary platform between professional boat rental companies and renters.

1.2 Definitions

APACA Location: The company Piba Location, trading commercially under the name APACA Location, is a simplified joint-stock company (SAS) with a share capital of €30,000, registered with the Toulon Trade and Companies Register under number 399 046 424 R.C.S Toulon, with its registered office at 28 bis Centre commercial du Nautisme, 83 400 HYÈRES, represented by its legal representative.
Owner: Any natural or legal person who owns or operates a boat, carries out a professional boat rental activity, and wishes to make a boat available to a Renter through the Site.
Renter: Any natural or legal person wishing to rent a boat from an Owner through the Site.
Site: www.location-de-catamaran.com
Services: Connecting natural or legal persons wishing to offer a boat for rent with natural persons wishing to rent a boat, through the Site developed by APACA Location.
Service fees: In consideration of its Services, APACA Location collects fees.

2. SCOPE OF APPLICATION

2.1 Scope of the Terms and Conditions

These Terms and Conditions apply to all bookings made on the Site, the purpose of which is to connect an Owner and a Renter for the purpose of renting a boat.

APACA Location acts exclusively as an intermediary: the platform enables the Renter to find a boat available for hire and the Owner to offer their vessel. The rental contract is concluded directly between the Owner and the Renter, who alone bear the obligations and liabilities arising from it.

Consequently, APACA Location is not a party to the rental contract and does not intervene in the contractual relationship between the Owner and the Renter. These relations are governed entirely by the terms of the rental contract signed between them.

APACA Location also offers on the Site certain boats that it manages directly. In such cases, APACA Location acts as the Owner. This situation concerns only a limited proportion of the available boats and is always clearly indicated on the corresponding listing.

2.2 Acceptance

These Terms and Conditions are freely accessible on the Site to any Owner or Renter. Before making a booking, the Renter acknowledges having read the Terms and Conditions and accepts them by ticking the box provided for this purpose.

2.3 Updates to the Terms and Conditions

APACA Location reserves the right to modify these Terms and Conditions at any time. Modifications take effect upon their publication on the Site.

3. ROLE OF APACA LOCATION

3.1 Nature as Intermediary

APACA Location acts exclusively as an intermediary and is never a party to the rental contracts concluded between Owners and Renters. It cannot under any circumstances guarantee the condition of the vessels, their compliance, the solvency of the Owners, or the safety of navigation.

3.2 Limits of Involvement

APACA Location is limited to hosting listings published by Owners, facilitating the connection between Owners and Renters, and providing a secure payment interface for transactions carried out on the Site.

4. CONDITIONS OF ACCESS TO THE SERVICE

4.1 Renter Registration

Registration on the APACA Location Site as a Renter is free and open to any person legally capable of entering into a contract. The Renter must provide their full identity, address, and a valid phone number by which they can be reached. Registration must be carried out under the Renter's true identity.

4.2 Exclusion

APACA Location reserves the right at any time to exclude without notice any Owner or Renter who fails to comply with these Terms and Conditions.

5. LISTING PUBLICATION

5.1 Mandatory Information

APACA Location collects information provided by Owners. The following data must be submitted in order to ensure complete and reliable listings: boat specifications, location of availability, photographs, equipment, security deposit amount, and availability periods.

5.2 Accuracy and Updates

APACA Location endeavours to hold the most reliable and complete information but cannot be held responsible for the accuracy thereof.

6. BOOKING AND RENTAL PROCESS

6.1 Booking Steps

The booking of a boat by a Renter follows these steps:

Selection of a boat
Booking or quote request
Acceptance by APACA Location in agreement with the Owner
Payment of deposit or full amount
Confirmation

6.2 Rental Contract

The rental contract is established between the Owner and the Renter.

6.3 Pre-Handover Inspection

Verification of the information provided by the Owner and the Renter — such as identity, condition and equipment of the boat, visas, certificates, navigation permits, or navigation competencies — is the responsibility of the Owner and the Renter.

The Renter may be required, under the rental contract binding them to the Owner, to pay a security deposit before taking charge of the boat. Unless otherwise stipulated by the Owner, the security deposit takes the form of a bank pre-authorisation completed no later than at Check-in.

In the event of damage, loss of equipment, abnormal cleaning requirements, missing fuel, late return, or a violation, the Owner may deduct all or part of the deposit, subject to supporting evidence (condition reports, photographs, estimates/invoices).

Any dispute relating to the security deposit or the Deposit Buyback is not the responsibility of APACA Location.

6.4 Condition Report

The Owner carries out an incoming condition report of the boat upon handover, commonly referred to as Check-in. At the end of the rental, an outgoing condition report, or Check-out, is carried out. Each Owner applies their own Check-in and Check-out procedure. APACA Location cannot be held liable for any disagreements between the parties regarding the arrival and departure condition reports.

6.5 Use of the Boat

Boats booked through the Site may only be used for recreational navigation purposes, unless expressly stated otherwise in the rental contract concluded with the Owner.

The Renter undertakes to:

Use the boat in a reasonable manner consistent with its intended purpose, comply with applicable navigation and customs regulations, and follow all safety instructions provided by the Owner.
Respect the navigation zones and the maximum passenger capacity.
Comply with the prohibition on carrying illicit substances or dangerous materials.
Comply with the prohibition on subletting or lending the boat.
Check the weather forecast before departure.
Immediately notify the Owner in the event of an emergency and, if necessary, the relevant authorities (CROSS, SNSM).

The Owner may require the presence of a professional skipper when the Renter's level of competence is insufficient.

Subletting and lending of the boat are strictly prohibited.

In the event of serious damage, the Renter must notify the Owner as soon as possible.

7. PAYMENT

The amount of the deposit and the rental price payable by the Renter are determined by the Owner. Failure to meet payment deadlines on the scheduled dates will result in cancellation of the contract by the Renter, with retention of the contractual fees.

Payment of the deposit and the rental price is made directly by the Renter to APACA Location. Payment by credit card or bank transfer is accepted.

The balance of the rental price may be paid directly to the Owner, in which case APACA Location cannot be held responsible for the potential insolvency of the Owner or the Renter.

Bank details entered by the Renter via the Site are not retained by APACA Location.

All online payments are firm and final. The Renter agrees not to request a refund of the rental price from their banking service provider.

In consideration of the Services, APACA Location collects service fees (fixed and/or proportional), displayed before payment and non-refundable except where required by mandatory law or where a credit note is provided under these Terms.

A service fee invoice is issued by APACA Location to the Owner. The Owner remains responsible for issuing their rental invoice to the Renter in accordance with applicable regulations.

8. INSURANCE

The Owner declares having taken out insurance covering the Renter's liability for the entire duration of the rental.

The insurance must in particular cover:

All damage that may be caused to the boat;
Losses resulting from damage;
Partial or total theft of the boat or its equipment;
The consequences of the Renter's civil liability towards third parties.

The Owner must inform the Renter of the risks covered and not covered by their insurance contract and, upon simple request, provide a copy thereof.

The Renter retains the option of taking out supplementary insurance with a specialist insurer to cover risks excluded from the Owner's contract, in particular through Ouest Assurances or Pantaenius. APACA Location strongly recommends taking out these additional guarantees.

9. CANCELLATION

9.1 Cancellation by the Renter

The Renter may cancel their booking at any time. However, cancellation fees will apply according to the following scale:

Time before the start of the rental	Cancellation fees
More than 90 days	30%
Between 90 and 60 days	50%
Between 60 and 30 days	70%
Less than 30 days	100% (full amount due)

APACA Location service fees remain non-refundable regardless of the cancellation date.

If the Owner succeeds in re-renting the boat for the same dates, the Renter may, at the sole discretion of the Owner, receive a partial or full refund. In such case, APACA Location service fees nevertheless remain due.

9.2 Cancellation by the Owner

The Owner may cancel a rental only in exceptional circumstances (breakdown, unforeseen event, incident rendering the boat unavailable).

In the event of cancellation by the Owner:

The Renter is fully refunded the amounts paid, excluding APACA Location service fees (which will be refunded in the form of a credit note).
APACA Location will, where possible, propose an equivalent alternative solution.
No additional compensation may be claimed from APACA Location.

9.3 Cancellation due to Force Majeure

In the event of force majeure as defined by Article 1218 of the French Civil Code (natural disaster, administrative prohibition, major incident, serious illness, death, etc.), the booking may:

Be postponed to a later date,
Be cancelled, with a refund in accordance with the Owner's applicable provisions.

APACA Location assumes no liability in the event of cancellation due to a force majeure event involving the Owner or the Renter.

9.4 Cancellation due to Weather Conditions

Adverse weather conditions do not give rise to a refund, unless a Special Weather Bulletin (BMS) prohibits any sea outing for all or part of the rental period.

In such case:

The rental may be postponed, subject to the Owner's availability.
If postponement is not possible, a refund may be granted in accordance with the conditions defined by the Owner.
APACA Location service fees may be refunded in the form of a credit note.

Ordinary weather conditions (strong wind, rain, swell, rough seas without a BMS) constitute a risk accepted by the Renter and do not entitle them to any refund.

9.5 Cancellation Procedure

All cancellation requests must be submitted in writing to the following email address: contact@apaca-location.fr

Cancellation is only effective upon written confirmation by APACA Location or the Owner.

10. LIABILITY

APACA Location makes every effort to ensure the proper functioning and availability of the Site. However, in the event of an interruption or malfunction, APACA Location's liability cannot be engaged.

The Site may contain links to third-party websites over which APACA Location has no control; no liability is incurred for their content, products, or services.

The User remains solely responsible for their equipment, connection, and the safeguarding of their data.

Likewise, APACA Location cannot be held liable for direct or indirect damages resulting from the conduct of the Owner or the Renter, or any failure on their part to comply with applicable legal or regulatory obligations.

Finally, APACA Location cannot under any circumstances be held liable for the loss, theft, or damage of personal belongings of the Renter during the rental of the boat.

11. GDPR — DATA PROTECTION

11.1 Personal Data and Cookies

APACA Location is committed to ensuring that the collection and processing of your data carried out through the Site complies with the General Data Protection Regulation (GDPR) and the French Data Protection Act (Loi Informatique et Libertés). Your personal data is confidential and will under no circumstances be shared with any third party, except where necessary for the proper execution of the service.

For statistical tracking purposes, the Site uses cookies. These are small text files stored on your hard drive that allow us to record technical data about your browsing.

11.2 Disputes

All content on the Site is subject to French and international legislation on copyright and intellectual property. For any information or to exercise your data protection rights regarding personal data managed by APACA Location, including the deletion of your data, please contact us by email at contact@apaca-location.fr or by post.

For bookings concluded with a consumer, the Renter is informed of the possibility of resorting free of charge to a consumer mediator in the event that a prior written complaint to APACA Location's customer service fails: contact@apaca-location.fr.

The Renter may also contact the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.

12. INTELLECTUAL PROPERTY

The Site, its structure, design, texts, images, logos, trademarks, photographs, databases, and more generally all content featured therein are protected by applicable laws relating to intellectual property.

Any reproduction, representation, adaptation, modification, translation, extraction, reuse, or distribution, in whole or in part, of the Site or any of its elements, by any means whatsoever, without the prior written authorisation of APACA Location, is prohibited.

The User is granted a strictly personal, non-exclusive, and non-transferable right of use of the Site, solely for the purpose of accessing the Services. Any unauthorised use shall engage the liability of its author.

13. PRICES, TAXES AND ADDITIONAL FEES

Unless otherwise stated, prices displayed on the Site are in euros and inclusive of all taxes (VAT included). The following items are not included in the price unless otherwise indicated on the listing or in the rental contract: fuel, consumables, skipper/crew, provisioning, port fees (berth, anchorage), end-of-rental cleaning, transfers, and optional extras.

Mandatory charges (for example, cleaning fees or port handling fees) are clearly indicated prior to booking confirmation. Local taxes (tourism, environmental, etc.) may apply depending on the embarkation location and remain the responsibility of the Renter.

14. REVIEWS AND RATINGS

Reviews published on the Site may only be submitted by Users who have actually completed a rental.

Reviews may be subject to moderation (including removal or refusal to publish) if they contain unlawful, abusive, defamatory, off-topic, or promotional content, personal data, or material that infringes the rights of third parties.

APACA Location may verify the authenticity of reviews by cross-referencing them with completed bookings. No consideration is provided in exchange for a review. The Owner has the right of reply within a reasonable timeframe.
